29 CFR 1910.272(j)(2)(ii):  The employer shall immediately remove any fugitive grain dust accumulations whenever they exceed 1/8 incy(.32 cm) at priority housekeeping areas, pursuant to the housekeeping program, or shall demonstrate and assure, through the development and implementation of the housekeeping progra, that equivalent protection is provided:        a)  The basment of the mill and the headhouse had not been cleaned in at least two weeks resulting in excessive accumulation of grain dust.

29 CFR 1910.134(k)(6):  A copy of Appendix D was not provided to employees who wore respirators when such use was not required by this section or by the employer:        a) The employer had not provide a copy of Appendix D of this standard to employees who voluntarily wore filtering face piece respirators while working in the mill or cleaning.
