29 CFR 1910.23(e)(1): Standard railings did not have a vertical height of 42 inches (106.7 cm) nominal from upper surface of top rail to floor, platform runway, or ramp level and the intermediate railing was not approximately halfway between the top rail and floor: Employees erecting industrial, free-standing shelving units from a Vestil forklift elevated work platform with toprail guardrailing set at a height of approximately 32 inches were exposed to falls of approximately 16 feet to the ground below and the employer did not ensure the platform guardrailing was at a height of 42 inches (106.7 cm).

29 CFR 1910.132(d)(1)(i): When the employer had assessed the workplace hazards and determined that hazards were present, the employer did not select and/or use the types of personal protective equipment that would protect the affected employee from the hazard identified: Employees erecting industrial, free-standing shelving units in the aluminum cable tray welding area were exposed to falls of approximately 16 feet to the ground below and the employer did not select and use the types of fall protection equipment that would prevent the employee from striking the ground in the event of a fall: A) Employees performing the shelving erection from a forklift elevated work platform were exposed to falls of approximately 16 feet to the ground below. B) Employees performing the shelving erection from the industrial shelving units under construction were exposed to falls of approximately 16 feet to the ground below.
