29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor  did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.    a) Erich Starkweather on or about October 21, 2011, at the address of 4027 Warner Way in Oregon, OH:  The employer did not assure employees were protected from falls of approximately ten feet, and up to approximately 18 feet while performing weatherproofing activities on the two story residential structure.      In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards:     a) Erich Starkweather on or about October 21, 2011, at the address of 4027 Warner Way in Oregon, OH:  The employer did not assure that employees were trained to recognize appropriate use of fall protection.  Employees performing roofing operations were exposed to a fall hazards of approximately 10 to 18 feet.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
