29 CFR 1910.1200(e)(1) The employer did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met:    (a) FreeWave Technologies, Inc. at 1880 S. Flatiron Ct. Suite F in Boulder, CO: The employer did not develop, implement, and maintain at the workplace a written hazard communication program which describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met.  This condition exposed employees to chemical and dust hazards.    Abatement Note: The written program must also include a list of hazardous chemicals and specify how employees will be trained prior to conducting non-routine tasks. 29 CFR 1910.1200(h)(1) Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area. Chemical-specific information must always be available through labels and material safety data sheets.    (a) FreeWave Technologies, Inc. at 1880 S. Flatiron Ct. Suite F in Boulder, CO: The employer did not provide employees with effective information and training on hazardous chemicals in their work area.  Production employees use soldering wire and flux pens.  In addition solder paste used at the SMT machine contains rosin. This condition exposed employees to chemical hazards.    Abatement Note:  Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1910.141(g)(2):  No employee shall be allowed to consume food or beverages in a toiletroom nor in any area exposed to a toxic material:    (a) FreeWave Technologies, Inc. at 1880 S. Flatiron Ct. Suite F in Boulder, CO: On and before October 27, 2011 employees were allowed to consume beverages in an area exposed to a toxic material in that production employees were allowed to have drinks at their work stations.  This condition exposed employees to health hazards including lead found in solder.
