29 CFR 1926.503(a)(2):     The employer shall assure that each employee has been trained, as necessary, by a competent personqualified in the following areas:    (a) The employer did not ensure that employees were using fall protection when conducting work while conducting roofing work. Employees were exposed to a fall hazard of approximately 18 feet. The employer did not ensure that the employees were trained to recognize and protect themselves from fall hazards.

29 CFR 1926.501(b)(13):     "Residential construction." Each employee engaged in residential construction activities 6 feet(1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provisionin paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it isinfeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets therequirements of paragraph (k) of 1926.502.Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fallprotection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complieswith 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.    The employer failed to ensure employees were protected from falls while conducting roofing activities on a residential roof.    (a) An employee was installing weather proofing material on the upper roof portion. The employee was exposed to a fall hazard of approximately 18 feet.    (b) An employee was putting shingles on and staging materials on the lower roof portion. The employee was exposed to a fall hazard of approximately 9 feet.    AD ROOFING L.L.C. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.100(a), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 313529703, CITATION NUMBER 1, ITEM NUMBER 1 AND WAS AFFIRMED AS A FINAL ORDER ON 09/22/10, WITH RESPECT TO A WORKPLACE LOCATED AT 2938 N.  SUMMIT AVE., MILWAUKEE, WI 53211.

29 CFR 1926.100(a):     Employees working in areas where there is a possible danger of head injury from impact, or from fallingor flying objects, or from electrical shock and burns, shall be protected by protective helmets.    (a) Employer did not ensure that employees were using head protection while working under personnel, material, and equipment. Employees were exposed to struck-by hazards.
