29 CFR 1910.147(c)(1):     Energy control program. The employer shall establish a program consisting of energy controlprocedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine orequipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.    Throughout facility - On or about September 1, 2011, the employer did not establish an energy control program for employees performing equipment repairs on electrical and hydraulic system of the baler and other operating equipment, thereby exposing employees to the hazard of unexpected energization of machinery.

29 CFR 1910.178(l)(1)(i):     The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).    Throughout facility - On or about September 1, 2011, operators were not trained in the safe operation of powered industrial trucks, thereby exposing all employees in the facility to struck by hazards.

29 CFR 1910.178(q)(7):     Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected.    Throughout facility - On or about September 1, 2011, the employer did not perform an examination of the powered industrial equipment to check for defects, thereby exposing employees to struck by hazards.

The guarding device shall be in conformity with any appropriate standards therefore, or, in the absence of applicable specific standards,shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle.    a.  Processing Area - On or about September 1, 2011, the employer did not provide a guard on the Genesco alligator shear, thereby allowing employees to reach into the point of operation.    b.  Processing Area -  On or about September 1, 2011, the employer did not provide a guard on the Deltax alligator shear, thereby allowing employees to reach into the point of operation.    c.  Processing Area - On or about September 1, 2011, the employer did not provide a guard on two CSX cable stripper's,  thereby allowing employees to reach into the point of operation.
