29 CFR 1926.651(k)(1):     Daily inspections of excavations, the adjacent areas, and protective systems shall be made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection shall be conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections shall also be made after every rainstorm or other hazard increasing occurrence. These inspections are only required when employee exposure can be reasonably anticipated.    a) At the site located along West Mound Street in Columbus, Ohio, the person that identified himself as the competent person on-site demonstrated inadequate skills necessary to recognize hazards associated with timber shoring, such as, but not limited to, missing cross-braces,  damaged lumber, and inadequate sized lumber for the whalers and cross-braces.     The Utilicon Corporation was previously cited for a violation of this occupational safety and health standard or its equivalent (1926.651(k)(1)), which was contained in OSHA inspection number 311605968, citation number 1, item number 3a, and was affirmed as a final order on November 14, 2008 with respect to a workplace located at U.S. 6 & Vineyard Rd., Avon Lake, Ohio 44012.

29 CFR 1926.652(a)(1):     Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c).     a)  On or about October 26, 2011 at the site located along West Mound Street in Columbus, Ohio, contractors were conducting construction work on a 20 inch water main in an open excavation, approximately 77 inches deep with an inadequate cave-in protection system.  The employer was using timber shoring at the site that did not meet the minimum specifications as outlined in 29 CFR 1926, Subpart P, Appendix C.    The Utilicon Corporation was previously cited for a violation of this occupational safety and helath standard or its equivalent (1926.652(a)(1)), which was contained in OSHA inspection number 311605968, citation number 1, item number 3b, and was affirmed as a final order on November 14, 2008 with respect to a workplace located at U.S. 6 & Vineyard Rd., Avon Lake, Ohio 44012.    The Utilicon Corporation was previously cited for a violation of this occupational safety and helath standard or its equivalent (1926.652(a)(1)), which was contained in OSHA inspection number 314108093, citation number 2, item number 1, and was affirmed as a final order on May 19, 2010 with respect to a workplace located at Old Freeport Road, Pittsburgh, PA.

29 CFR 1926.652(c)(1):   Option (1) - Designs using appendices A, C and D. Designs for timber shoring in trenches shall be determined in accordance with the conditions and requirements set forth in appendices A and C to this subpart. Designs for aluminum hydraulic shoring shall be in accordance with paragraph (c)(2) of this section, but if manufacturer's tabulated data cannot be utilized, designs shall be in accordance with appendix D:    a.  at the site located along West mound Street in Columbus, Ohio, timber shoring did not meet requirements set forth in appendices A and C to Subpart B - excavations.
