29 CFR 1926.652(c)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c): On or about July 8, 2015, at a worksite located at Scranton Road and Barber Avenue, Cleveland, OH 44113, the employer did not ensure protective systems selected and constructed by the employer were in accordance with requirements in that plywood and one 2 X 4 lumber strut or crossbrace did not meet the requirements in Appendix C. A ladder was placed in the excavation making entry into the 7 feet excavation reasonably foreseeable. Utilicon Corporation was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(c)(1), which was contained in OSHA inspection number 108162, citation number 01, item number 003 and was affirmed as a final order on November 5, 2012, with respect to a workplace located at 1516 West Mound Street, Columbus, OH 43223.
