29 CFR 1926.103   The requirements applicable to construction work are identical to those set forth at 29 CFR 1910.134    29 CFR 1910.134(c)(1):     A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:    (a) On or about 26 August 2011, the employer did not establish and implement a written respiratory protection program in accordance with 29 CFR 1910.134 (c)(1) that would describe or include at least the following:    1)	Procedures for selecting respirators;  2)	Worksite specific procedures;  3)	Medical evaluations;  4)	Fit testing procedures;  5)	Procedures for proper use of respirators in routine and reasonably foreseeable emergency;  6)	Procedures and schedules for cleaning, storing, inspecting, repairing and discarding respirators;  7)	Employee training regarding respiratory hazards they are exposed to, proper use and limitations of respirators; and  8)	Procedures for regularly evaluating the effectiveness of the respirator program    The employer required of employee(s) to wear Gerson Model 1740 N95 Mask Negative Pressure Respirator(s) while engaged in brick cutting and tuckpointing operations associated with lintel replacement.  The employer did not ensure that where respirators were required, a written respiratory protection program was established and maintained.  A written respiratory protection program had not been written for this company.     In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.103   The requirements applicable to construction work are identical to those set forth at 29 CFR 1910.134    29 CFR 1910.134(e)(1):     The employer did not provide a medical evaluation to determine the employee���s ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:    (a) On or about 29 August 2011, the employer required of employee(s) to wear Gerson Model 1740 N95 Mask Negative Pressure Respirator(s) while engaged in brick cutting and tuckpointing operations associated with lintel replacement.  The employer did not provide a medical evaluation to determine the employees ability to use a respirator before the employee was fit-tested or required to use the respirator in the workplace.   A written respiratory protection program had not been written for this facility.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR 1926.103   The requirements applicable to construction work are identical to those set forth at 29 CFR 1910.134    29 CFR 1910.134(f)(2):     The employer did not ensure that an employee using a tight-fitting facepiece respirator was fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter.    (a) On or about 29 August 2011, the employer required of employee(s) to wear Gerson Model 1740 N95 Mask Negative Pressure Respirator(s) while engaged in brick cutting and tuckpointing operations associated with lintel replacement.  The employer did not ensure that employees using a tight-fitting facepiece respirator were fit-tested either qualitatively (QLFT) or quantitatively (QNFT) prior to the initial use of the respirator.       In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.103   The requirements applicable to construction work are identical to those set forth at 29 CFR 1910.134     29 CFR 1910.134(k)(1):     The employer did not ensure that each employee can demonstrate knowledge of items in (i)-(vii)    (a) On or about 29 August 2011, the employer required of employee(s) to wear Gerson Model 1740 N95 Mask Negative Pressure Respirator(s) while engaged in brick cutting and tuckpointing operations associated with lintel replacement.  The employer did not ensure that each employee demonstrated knowledge what the capabilities of a respirator are and how improper fit and usage can compromise the protective effect of the respirator.  The employee(s) cut the lower strap of the respirator therefore inducing a lack of fit on the facing and reducing the protection form airborne silica hazards.     In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.59 The requirements applicable to construction work under this section are identical to those set forth at 29 CFR 1910.1200    29 CFR 1910.1200(h)(1):     Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:    (a) On or about 26 November 2011, the employer did not provide employees with training regarding the hazards of the hazardous chemicals present in the work area.  Employee(s) engaged in brick cutting and tuckpointing operations associated with lintel replacement were exposed to hazardous chemicals including but not limited to crystalline silica. 29 CFR 1926.100(b):     Helmets for the protection of employees against impact and penetration of falling and flying objects did not meet the specifications contained in American National Standards Institute Z89.1-1969, Safety Requirements for Industrial Head    (a) On or about 26 August 2011, the employer did not provide employee(s) with protective helmets that met the specifications of the ANSI Z89.1-1969, Safety Requirements for Industrial Head protection.  The ground person, foreman, was wearing a bump cap that did not protect against impact and penetration of falling and flying objects from the tuckpointers working on a scaffold above.      No abatement certification or documentation is required for this item.
