29 CFR 1926.453(b)(2)(v): A body belt was not worn and a lanyard was not attached to the boom or basket when working from an aerial lift: (a) In front of the building on or about November 7, 2011, the lanyard was not properly attached to the aerial lift basket as it was attached to the basket's guardrails instead of the tie off ring near the basket platform as instructed by a manufacturer's label on the lift. The aerial lift, model number MHP15/44, serial number N2080436, was made by Snorkel in New Zealand in April 2008. An employee painted the exterior of the building from the lift's basket about 21 feet above the concrete below.

29 CFR 1926.1053(b)(4): Ladders were not used only for the purpose for which they were designed: (a) In front of the building on or about November 7, 2011, an eight foot long step ladder was used in the folded up position and leaned against the exterior wall. An employee stood on the sixth rung from the bottom and painted the exterior of the building.

29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact: (a) In front of the building on or about November 7, 2011, eye protection was not worn when Behr Premier Base Exterior Paint, No. 4400, was rolled on the exterior of the building. The label on the paint container said to WEAR EYE PROTECTION AND PROTECTIVE CLOTHING. There was paint on the employee's arms and face. (b) In front of the building on or about November 7, 2011, protective clothing was not worn when Behr Premier Base Exterior Paint, No. 4400, was rolled and brushed on the exterior of the building. The label on the paint container said to WEAR EYE PROTECTION AND PROTECTIVE CLOTHING. There was paint on the employees' arms and faces
