29 CFR 1926.451(e)(1):     When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portableladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps,walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall beused. Crossbraces shall not be used as a means of access.    Wharf Project:  On or about 11/3/2011, and times prior thereto, employees were accessing supported scaffolds from floats without ladders or other means to facilitate safe passage; exposing employees of fall hazards onto steel support beams of the wharf or into the water.

29 CFR 1926.451(g)(1)(vii):     For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee shall be protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4)of this section.    Wharf Project:  On or about 11/3/2011, and times prior thereto, employees were working on supported scaffolds to perform piping installation and insulation operations; exposing employees of fall hazards of over 10 feet onto steel support beams of the wharf or into the water.

Cargo Wharf Area:  On or about 3 November 2011, and times prior thereto, the forklift operator operating the Caterpillar all-terrain forklift for the site had not been evaluated on his performance since training conducted in April 1999.

29 CFR 1926.351(b)(4):     Cables in need of repair shall not be used. When a cable, other than the cable lead referred to inparagraph (b)(2) of this section, becomes worn to the extent of exposing bare conductors, the portion thus exposed shall be protected by means ofrubber and friction tape or other equivalent insulation.    MKB work site:  On or about November 3, 2011 and times prior thereto, arc welding cable was used that had exposed conductors.  This exposed employees to possible shock hazards if they were to come in contact with the conductor.
