29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact: On November 3, 2011, while using Medina Supplies Grout in masonry duties, the employer failed to ensure employees used proper gloves to limit the exposure to portland cement.

29 CFR 1926.451(g)(4)(i): Guardrail systems were not installed along all open sides and ends of platforms before being released for use by employees other than erection/dismantling crews: On or about November 7, 2011, while delivering bricks and mud to masons, an employee was exposed to an approximate 10 foot 6 inch fall without proper fall protective system/devices in place. STANLEY MILLER CONSTRUCTION WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 1926.451 (G)(4)(I), WHICH WS CONTAINED IN OSHA INSPECTION NUMBER 311834311, CITATION NUMBER 01, ITEM NUMBER 003 AND WAS AFFIRMED AS A FINAL ORDER ON OCTOBER 6, 2008, WITH RESPECT TO A WORKPLACE LOCATED AT 47201 COUNTY ROAD 273, CONESVILLE, OH 43811.
