29 CFR 1910.132(a): 'Application. Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact.    a.  On or about November 14, 2011, in the facility, employees were required to work with chemicals including, but not limited to 4,4-diphenylmethane diisocyanate and petroleum distillates.  Employees were not provided or required to wear personal protective equipment, including but not limited to safety glasses and protective chemical resistant gloves when working with the chemicals.

29 CFR 1910.132(d)(1):  The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). If such hazards are present, or likely to be present, the employer shall:    a.  On or about November 14, 2011, in the facility, employees were required to work with chemicals including, but not limited to 4,4-diphenylmethane diisocyanate and petroleum distillates.  The employer failed to perform a personal protective equipment assessment to determine which hazards existed which necessitated the use of personal protective equipment.

29 CFR 1910.132(f)(1):  The employer shall provide training to each employee who is required by this section to use personal protective equipment (PPE).  Each such employee shall be trained to know at least the following:    a.  On or about November 14, 2011, in the facility, employees were required to work with chemicals including, but not limited to 4,4-diphenylmethane diisocyanate and petroleum distillates.  The employer failed to provide training for employees who were exposed to the chemicals on what personal protective equipment was necessary, when it was necessary and the limitations of the personal protective equipment.

29 CFR 1910.303(b)(2):  Installation and use. Listed or labeled equipment shall be installed and used in accordance with any instructions included in the listing or labeling.    a.  On or about January 5, 2012, in the assembly room, the employer had a battery charger connected to an automobile battery, which had battery cables attached to a metal rod located in an open bucket of caustic water.  The employer failed to use UL listed or labeled equipment in accordance with the manufacturer designated use(s) thereby exposing employees to electrical and explosion hazards.

On or about November 14, 2011, in the facility, employees were required to work with chemicals including, but not limited to 4,4-diphenylmethane diisocyanate and petroleum distillates.  The employer had not developed and implemented a written hazard communication program including, but not limited to labeling, material safety data sheets and training procedures.
