29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:    a) Jobsite: On November 10, 2011 and times prior thereto employees performed sheathing activities on a six in twelve and seven in twelve pitched roof without a fall protection system in place.       b) Jobsite: On November 10, 2011 and times prior thereto employees performing framing activities were exposed to a fall hazard from the second floor level where a guardrail system was not in place along an open sided floor.      Note) Abatement certification IS required for this item.

29 CFR 1926.503(a)(2)(ii): The employer did not assure that each employee had been trained, as necessary, by a competent person in the use and operation of guardrail systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used:    a) Jobsite: On November 10, 2011 and times prior thereto the responsible person on site and employees performing framing activities were not familiar with fall protection systems required for residential construction.    b) Jobsite: On November 10, 2011 and times prior thereto the responsible person and employees performing framing activities did not recognize the hazard of an open sided floor, and take action to minimize or eliminate this hazard. 29 CFR 1926.1052(c)(1)(ii): Stairways having more than four risers or rising more than 30 inches was not equipped with one stairrail system along each unprotected side or edge:      a) Jobsite: On November 10, 2011 and times prior thereto the interior stairway used for access to and from the second floor level did not have a stairrail system in place.  Stairway had approximately 11 risers.    Note) Abatement certification IS required for this item.

Note 1) Ada-Can Construction, Inc ., was previously cited for a violation of this Occupational Safety and Health standard which was contained in OSHA inspection number 313352601, citation 2, item 2, and was affirmed as a final order on August 18, 2010, with respect to a workplace located at 2542 Vizcaya, Eagle, ID.     Note 2) Abatement certification and documention ARE required for this item.
