29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph (b). Note: If using these systems was infeasible or created a greater hazard, the employer should develop and implement a fall protection plan meeting the requirements of paragraph (k) of 1926.502. (a) On or about June 11, 2012, and at times prior thereto, the exposing employer did not provide employees with adequate fall protection while working on the top plate, on the front side of the residence, placing blocks between trusses at heights of approximatley 17 feet. (b) On or about June 11, 2012, and at times prior thereto, the exposing employer did not provide employees with adequate fall protection while working on the trusses, near the middle of the residence, at heights of approximatley 17 feet above the concrete foundation. Note: Abatement certification is required for this item.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: (a) On or about June 11, 2012, and at times prior thereto, employees were working below other worker(s) framing on the trusses of the house. Note: Ada-Can Construction, Inc. was previously cited OTHER-THAN-SERIOUS, for a substantially similar violation of this occupational safety and health standard, which was contained in OSHA inspection number 313352601, citation number 2, item number 1, and was affirmed by a final order on August 19, 2010, with respect to a workplace located at 2542 Vizcaya, Eagle, Idaho 83616. Note: Abatement certification and documentation is required for this item.
