29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    (a) American Insulating Window Company, Inc. Dba Liberty Home Products, 358 S. Navajo St., Denver, CO 80223: On or before 11/16/11, the employer did not develop, implement, and maintain at the workplace a site specific written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met.  The employer utilizes products such as, but not limited to:    (1) GF PHOS 427  (2) Cardinal polyester powder paint              Abatement note:  The written hazard communication program will also include:    (1) A list of the hazardous chemicals known to be present using an identity that is referenced on the appropriate material safety data sheet (the list may be compiled for the workplace as a whole or for individual work areas); and,    (2) The methods the employer will use to inform employees of the hazards of non-routine tasks.

29 CFR 1910.1200(f)(5): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged, or marked with the identity and appropriate hazard warnings regarding the chemicals contained therein:    (a) American Insulating Window Company, Inc. Dba Liberty Home Products, 358 S. Navajo St., Denver, CO 80223: On and before 11/16/11, the employer did not ensure that the tank used for the auto wash machine was labeled, tagged, or marked with the identity and appropriate hazard warnings regarding the chemicals contained therein.  The tank holds a mixture of GF PHOS 427 and water.  This condition exposes employees to a chemical hazard.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:                            (a) American Insulating Window Company, Inc. Dba Liberty Home Products, 358 S. Navajo St., Denver, CO 80223: On and before 11/16/11, the employer did not provide effective information and training to employees regarding the health and safety hazards of the hazardous chemicals in their work area.  This condition exposed employees to a chemical hazard.    Abatement note: Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals.  Chemical specific information must always be available through labels and material safety data sheets.

29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible:      (a) American Insulating Window Company, Inc. Dba Liberty Home Products, 358 S. Navajo St., Denver, CO 80223: On and before 11/16/11, the employer did not ensure that any employee using a respirator voluntarily was provided with the information contained in Appendix D to this section when the employer determined that any voluntary respirator use was permissible.  The employer provided N95 filtering face piece respirators for voluntary use.  This condition exposed the employees to a respiratory hazard.
