Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which is free from recognized hazards that cause or likely to cause death or serious physical harm to employees, in that the employee who rode the bucket of the hydraulic excavator into a trench was not protected from fall or struck by hazards. a) DiGioia-Suburban Excavating, LLC, at the worksite located near 1155 North Main Street, Bowling Green, OH: The employer did not prohibit employees from riding the bucket of the Komatsu PC400LC hydraulic excavator to be lowered into the excavation approximately 16 ft deep exposing the employee to fall or struck by hazards from an inadvertent operation and movement, as observed on November 17, 2011.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress is not located in the trench excavations that is 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: a) DiGioia-Suburban Excavating, LLC, at the worksite located near 1155 North Main Street, Bowling Green, OH: The employer does not assure a safe means of egress, such as a ladder, is used by employees when installing a sanitary sewer line in a 16 1/2 feet deep trench, as observed on November 17, 2012. To abate this violation, the employer must assure there is a safe means of egress for employees when performing work in a trench excavation that is four feet or more in depth.
