29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c): a) On or about November 18, 2011 and at times prior, employees were not protected from injury in that, they were working next to and near an unprotected, vertical foundation excavation walls and placing forms against these walls. The soil showed evidence of fissures, cracking and deterioration.
