29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: A: On or about 11/29/11 during new sign installation which included attaching plywood templates to the outside of a building, the employer did not ensure employees used fall protection systems/devices when transferring from a hoisted personnel platform to the roof of a building. B: On or about 11/29/11 during new sign installation which included attaching plywood templates to the outside of a building, the employer did not ensure employees had proper fall protection equipment when working on a roof top of a building. The employees had a six foot lanyards and a harness, they had to come to the edge of the roof to tie off and should of used rope grabs or other methods to ensure employees were 100% protected from falls when working on the roof top.

29 CFR 1926.1431(a): The use of equipment to hoist employees is prohibited except where the employer demonstrates that the erection, use, and dismantling of conventional means of reaching the work area, such as a personnel hoist, ladder, stairway, aerial lift, elevating work platform, or scaffold, would be more hazardous, or is not possible because of the project's structural design or worksite conditions. This paragraph does not apply to work covered by subpart R (Steel Erection) of this part: On or about 11/29/11 during new sign installation which included the attachment of plywood templates to the outside of a building, the employer did not prove that the use of a personal platform used to hoist employees by a crane was the least hazardous method to conduct this activity. Other feasible and less hazardous methods include using a swing stage scaffold to perform the work.
