29 CFR 1926.501(b)(12): The employer did not ensure that each employee engaged in the erection of precast concrete members (including, but not limited to the erection of wall panels, columns, beams, and floor and roof "tees") and related operations such as grouting of precast concrete members, who is 6 feet or more above lower levels was not protected from falling by guardrail systems, safety net systems, or personal fall arrest systems, unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. The employer did not demonstrate that it was infeasible or created a greater hazard to use these systems: (a) ICS, Inc. at 6392 114th Avenue NW, Ray, ND 58849: On or about November 1, 2011, the employer did not ensure that a precast contractor employee was protected from falling when accessing the top landing, in that the lower landing included an opening measuring 90' long high x 6' high next to a step ladder used for access. Condition exposed employee to fall hazards of approximately 30'.

29 CFR 1926.1053(b)(13): The top or top step of a step ladder was used as a step: (a) ICS, Inc. at 6392 114th Avenue NW, Ray, ND 58849: On or about November 1, 2011, the employer allowed a precast contractor employee to use the top and the top step of an 8' Werner stepladder when accessing the top landing. Condition exposed employee to 8' fall hazards.
