29 CFR 1910.178(a)(6): The employer did not ensure that all nameplates or markings were not maintained in a legible condition: a) Southern Pacific, Inc. Warehouse- On or about November 30, 2011 and at times prior thereto, the toyota forklift truck's lable was painted over rendering it unreadable.

29 CFR 1910.178(p)(1): Where powered industrial trucks were found to be in need of repair, defective, or in any way unsafe, the trucks were not taken out of service until they had been restored to safe operating condition a) Southern Pacific, Inc., Warehouse- On or about November 30, 2011 and at times prior thereto, the toyota forklift truck had no horn on the steering wheel. Also, a tarp was covering the overhead guards of two forklifts, obstructing the operator's view when loading materials.
