29 CFR 1926.404(b)(1)(iii):     Where ground-fault circuit interrupters were not utilized, employer did not establish and implement an assured equipment grounding conductor program on the construction site covering all cord sets, receptacles which are not part of the building or structure, and equipment connected by cord and plug which are available for use or used by employees:    a.) Tech-Rite Builders Hagatna- On or about December 02, 2011 and at times prior thereto, employees were using a wall outlet. The wall outlet was tested and the ground fault circuit interrupter (GFCI) did not work.  The employer did not develop an assured equipment grounding conductor program.

29 CFR 1926.502(d)(8):     Horizontal lifelines were not designed, installed, and used under the supervision of a qualified person, as part of a complete personal fall arrest system, which maintained a safety factor of at least two:    a)  Tech-Rite Builders, Hagatna Building- On or about December 01,2011 and at times prior thereto, two employees were on the roof by the edge and were working on the rebar steel forms. The employees were wearing personal fall arrest equipment but were not tied off to horizontal lifelines.  Employees were exposed to a fall of 15 feet.

29 CFR 1926.1053(b)(1):     Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladders length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.    a) Tech-Rite Builders, Hagatna Building- On or about December 02, 2011 and at times prior thereto, employees were using a portable A frame ladder.  The ladder did not extend at least 3 feet above the landing or secured at the top to a rigid support and a grasping device was not provided to assist employees in mounting and dismounting the ladder.

1926.501(b)(1):    Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8m) or more above a lower level were not protected from falling by the use of guardrail system, safety net system, or personal fall arrest system.     a) Tech-Rite Builders Hagatna- On or about December 02, 2011 and at times prior thereto, two employees were equipped with personal fall arrest equipment but were not attached a lifeline.  In addition, another employee was not wearing personal fall arrest equipment.  The employees were exposed to a 15 foot fall while working on a roof.
