29 CFR 1926.501(b)(1): Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:   In the rear of the building on or about November 18, 2013, there was no fall protection for a 6 foot opening in the guardrails on the mezzanine.  There was barricade tape across the opening.  It was 11 feet, 2 inches from the mezzanine to the concrete floor below.  Employees removed the guardrails from the opening so materials could be lifted up to and placed on the mezzanine.

29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact:   At the north side exterior wall of the building on or about November 18, 2013, gloves were not worn while rolling on paint.  The paint was Sherwin Williams A-100 Exterior Acrylic Latex Deep Base Flat 6403-99689.  The warning label said to avoid contact with skin.  The material safety data sheet says to wear gloves which are recommended by glove supplier for protection against materials in Section 2.
