29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program, as described in paragraphs (c) through (o) of this section, whenever employee noise exposures equaled or exceeded an 8-hour time-weighted average sound level (TWA) of 85 decibels measured on the A scale (slow response) or, equivalently, a dose of fifty percent:    (a) Commercial Resins Company at 8100 E. 96th Ave. in Henderson, CO: The employer did not administer a continuing, effective hearing conservation program.  On December 20, 2011 Employee A was exposed to noise at a sound level of 87.4 dBA, which corresponded to a dose of 70.56%.  On the same day Employee B was exposed to noise at a sound level of 87.5 dBA, which corresponded to a dose of 70.7%.  This condition exposed employees to a noise hazard.    Abatement Note: OSHA maintains a noise and hearing conservation program webpage: http://www.osha.gov/SLTC/noisehearingconservation/standards.html  In general, a hearing conservation program must include the following:  Monitoring;  Employee notification of noise monitoring results;  Provision for affected employees to observe measurements;  Audiometric testing;  Compliance with Appendix C  "Audiometric Measuring Instruments" and Sppendix D "Audiometric Test Rooms";  Audiometer calibration;  Types and use of hearing protectors;  Training; and  Recordkeeping. This condition exposed employees to a noise hazard.    Abatement Note: Noise monitoring is intended to identify employees for inclusion in the hearing conservation program and to enable the proper selection of hearing protectors. 29 CFR 1910.1200(e)(1) The employer did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met:    (a) Commercial Resins Company at 8100 E. 96th Ave. in Henderson, CO: The employer did not develop, implement, and maintain at the workplace a written hazard communication program which describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met.  The program provided was developed for a different facility and did not include information pertinent to the Henderson facility.  The program did not include a hazardous chemical list, specify who would obtain and maintain MSDSs, specify where MSDSs are located, or provide for training of temporary workers at this facility. This condition materially impaired the employer's ability to record and report workplace fatalities, injuries, and illnesses. 29 CFR 1910.134(d)(1)(iii) The employer did not identify and evaluate the respiratory hazard(s) in the workplace:     (a) Commercial Resins Company at 8100 E. 96th Ave. in Henderson, CO: On and before December 14, 2011 the employer did not evaluate the respiratory hazards in the workplace in that employees working near the spray booth and wheel abrader were not evaluated for respirable dust exposure.  This condition exposed employees to a respiratory hazard.    (b) Commercial Resins Company at 8100 E. 96th Ave. in Henderson, CO: On and before December 14, 2011 the employer did not evaluate the respiratory hazards in the workplace in that employees who enter the blast machine, a permit required confined space, have not been monitored for exposure to metal fumes generated during hot work.  This condition exposed employees to a respiratory hazard.    Abatement Note: This evaluation shall include a reasonable estimate of employee exposures to respiratory hazard(s) and an identification of the contaminant's chemical state and physical form. Where the employer cannot identify or reasonably estimate the employee exposure, the employer shall consider the atmosphere to be IDLH.
