Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to combustible waste bakery products dust deflagration and explosion hazards while working at or near cyclone-style air-material separators and associated equipment which were not adequately designed to prevent or minimize employee exposure in the event of a deflagration: (a) Griffin Industries, LLC, dba Bakery Feeds, 12850 Quarry Road, North Baltimore, Ohio; On or about December 22, 2011, the employer did not ensure that employees were protected from waste bakery products dust deflagration and explosion hazards. The employees were exposed to hazards from cyclone #1 which was an air-material separator located inside the building and connected to the rotary drum dryer and which lacked means of (1) explosion protection and (2) deflagration isolation from process equipment. (b) Griffin Industries, LLC, dba Bakery Feeds, 12850 Quarry Road, North Baltimore, Ohio; On or about December 22, 2011, the employer did not ensure that employees were protected from waste bakery products dust deflagration and explosion hazards. The employees were exposed to hazards from cyclone #2 which was an air-material separator located inside the building and connected to the rotary drum dryer and which lacked means of (1) explosion protection and (2) deflagration isolation from process equipment. (c) Griffin Industries, LLC, dba Bakery Feeds, 12850 Quarry Road, North Baltimore, Ohio; On or about December 22, 2011, the employer did not ensure that employees were protected from waste bakery products dust deflagration and explosion hazards. The employees were exposed to hazards from the cooling screw conveyor cyclone which was an air-material separator located inside the building and which lacked means of (1) explosion protection and (2) deflagration isolation from process equipment. Among other methods, a feasible method to correct this hazard would be to comply with National Fire Protection Association (NFPA) Standards 654 "Standard for the Prevention of Fire and Dust Explosions from the Manufacturing, Processing, and Handling of Combustible Particulate Solids, 2006 Ed." - Sections 7.1.2, 7.1.4, 7.1.5, 7.13.1.1.1, 7.13.1.3.1, 7.13.1.5, and/or to comply with FM Global Property Loss Prevention Data Sheet 7-73 "Dust Collectors and Collection Systems, January 2012" - Section 2.2.1.1 and FM Data Sheet 7-76 "Prevention and Mitigation of Combustible Dust Explosions and Fire, January 2012" - Sections 2.3.1, 2.3.2, 2.3.3, 2.5.2.

29 CFR 1910.132(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers were not provided, used, and maintained in a sanitary and reliable condition whenever is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact. (a) Griffin Industries, LLC, dba Bakery Feeds, 12850 Quarry Road, North Baltimore, Ohio; On or about December 22, 2011, the employer did not ensure that employees entering process equipment, where combustible material is present, were protected from serious injuries. Employees did not wear fire resistant clothing when they entered the drum dryer, drop-box, and cyclone air-material separators to clean them of accumulated combustible material.

Under normal operations the dust from the cyclones and the finished product was explosive and could present an explosive atmosphere when airborne.
