29 CFR 1904.39(a): The employer did not orally report the death of an employee because of a work-related incident within eight (8) hours of the occurrence to the nearest Area Office of the Occupational Safety and Health Administration or to the OSHA toll-free central telephone number (1-800-321-OSHA). Navy Exchange, Naval Base San Diego - On or about September 9, 2011, the employer failed to report to OSHA a work-related death when an employee suffered a heart attack September 3, 2011. The employer contacted the nearest OSHA office September 7, 2011 to report the death of the employee.
