29 CFR 1904.39(a): The employer did not orally report the death of an employee or the in-patient hospitalization of three or more employees because of a work-related incident within eight (8) hours after the occurrence to the nearest Area Office of the Occupational Safety and Health Administration or to the OSHA toll-free central telephone number (1-800-321-OSHA). At the facility - On or about December 25, 2011, A US Postal Service employee suffered a heart attack at work on December 25, 2011 at approximately 10:30 PM, the employer was notified of the employee's death December 26, 2011 at 12:15 am, and did not report the fatality to the Depart of Labor - OSHA until the following day, December 27, 2011.
