OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards due to the lack of a hoistway enclosure:    On or about January 4, 2012, the freight elevator did not have an enclosure at the shaftway opening located in the basement.  Employees were thereby exposed to crushing hazards in the event the elevator car came down when employees were in the shaftway.  In addition, the employer did not have periodic inspections of the elevator conducted.

29 CFR 1910.37(a)(3): Exit routes must be free and unobstructed. No materials or equipment may be placed, either permanently or temporarily, within the exit route. The exit access must not go through a room that can be locked, such as a bathroom, to reach an exit or exit discharge, nor may it lead into a dead-end corridor. Stairs or a ramp must be provided where the exit route is not substantially level.    171 N. Green Street - On or about January 4, 2012, the emergency exit routes were obstructed by a rolling overhead door, wood and tools, thereby exposing employees to smoke inhalation and burns.

Emergency illumination shall include all required means of egress lighting, illuminated exit signs, and all other lights necessary to provide illumination. Where emergency lighting is necessary, the system shall be so arranged that the failure of any individual lighting element, such as the burning out of a light bulb, cannot leave any space in total darkness.    171 N.
