On or about January 4, 2012, in the basement of 171 N. Green St., Chicago, IL 60607, in the varnish area(s) and the spray area(s), employees required to perform painting & varnishing opertions adjacent to flammable liquid application operations were exposed to fire and/or smoke hazards associated with flammable liquids. Electrical equipment, including outlets, switches, lights and fans were not intrinsically safe, approved for Class 1 Division 2 hazardous (classified) location or safe for the Class 1, Division 2 hazardous (classified) location.

29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning,material safety data sheets, and employee information and training will be met, and which also includes the following: a. On or about January 4, 2012, in the facility, employees required to perform wooden display contruction, painting & varnishing were exposed to contact with hazardous materials, including but not limited to mineral spirits, acetone, xylene, n-butyl acetate, ethylbenzene, 1,2,4 - trimethylbenzene. The employer did not develop, implement and/or maintain at the workplace a written hazard communication program.

29 CFR 1910.1200(h)(1): Employees were not provided information and training as specified in 29 CFR 1910.1200(h)(1) and (2) on hazardous chemicals in their work area are the time of their initial assignment and whenever a new hazard was introduced into their work area: a. On or about January 4, 2012, in the facility, employees required to perform display construction, painting and varnishing were exposed to contact with hazardous materials, including but not limited to mineral spirits, acetone, xylene, n-butyl acetate, ethylbenzene, 1,2,4 - trimethylbenzene. Employees were not provided with adequate and effective training including: (i) Methods and observations that may be used to detect the presence or release of a hazardous chemical in the work area (such as monitoring conducted by the employer, continuous monitoring devices, visual appearance or odor of hazardous chemicals when being released, etc.); (ii) The physical and health hazards of the chemicals in the work area; (iii) The measures employees can take to protect themselves from these hazards, including specific procedures the employer has implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures, and personal protective equipment to be used; and, (iv) The details of the hazard communication program developed by the employer, including an explanation of the labeling system and the material safety data sheet, and how employees can obtain and use the appropriate hazard information.
