29 CFR 1910.1028(e)(1)(iii): Determinations of compliance with the STEL were not made from 15-minute employee breathing zone samples measured at operations where there was reason to believe exposures were high: (a) Suncor Energy (USA), Inc., 5801 Brighton Blvd., Commerce City, CO: On and before 1/4/12, the employer did not take 15-minute employee breathing zone samples of the light oil operators when product samples were taken. The light oil operators normally take four product samples once per shift. The samples are taken in series from separate sample lines and drained into open containers. On 4/13/12, the Plant 1 light oil reformer operator took samples of the WSI reformate, HDS charge, HDS naphtha, and HDS jet 50 in approximately 11 minutes. (b) Suncor Energy (USA), Inc., 5801 Brighton Blvd., Commerce City, CO: On and before 1/4/12, the employer did not take 15-minute employee breathing zone samples of the light oil operators during steamout operations. The light oil operators perform steamout operations before regular and emergency maintenance, and turnaround. Any remaining hydrocarbons are released into the atmosphere when operators steam to the ground for final discharge. The light oil operators enter the area to open/close valves and check on the operation. (c) Suncor Energy (USA), Inc., 5801 Brighton Blvd., Commerce City, CO: On and before 1/4/12, the employer did not take 15-minute employee breathing zone samples of the heavy oil operators during steamout operations. The heavy oil operators perform steamout operations before regular and emergency maintenance, and turnaround. Any remaining hydrocarbons are released into the atmosphere when operators steam to the ground for final discharge. The heavy oil operators enter the area to open/close valves and check on the operation. (d) Suncor Energy (USA), Inc., 5801 Brighton Blvd., Commerce City, CO: On and before 1/4/12, the employer did not take 15-minute employee breathing zone samples of the OMD operators during steamout operations. The OMD operators perform steamout operations before regular and emergency maintenance, and turnaround. Any remaining hydrocarbons are released into the atmosphere when operators steam to the ground for final discharge. The OMD operators enter the area to open/close valves and check on the operation.

29 CFR 1910.1028(e)(5)(i): The employer did not institute the exposure monitoring required under paragraphs (e)(2) and (e)(3) when there was a change in the production process, control equipment, personnel or work practices which could result in new or additional exposures to benzene, or when the employer had any reason to suspect a change which could have resulted in new or additional exposures: (a) Suncor Energy (USA), Inc., 5801 Brighton Blvd., Commerce City, CO: On and before 1/4/12, the employer did not institute the exposure monitoring required under paragraphs (e)(2) and (e)(3) when the employer had any reason to suspect a change which could have resulted in new or additional exposures. The employer discovered an underground source of benzene on the Suncor property which volatilized into the North Office Complex (NOC). The employer did not institute an air monitoring program to determine employee exposure to benzene. Low levels of airborne benzene were found in the NOC. (b) Suncor Energy (USA), Inc., 5801 Brighton Blvd., Commerce City, CO: On and before 1/4/12, the employer did not institute the exposure monitoring required under paragraphs (e)(2) and (e)(3) when the employer had any reason to suspect a change which could have resulted in new or additional exposures. The employer discovered an underground source of benzene on the Suncor property which volatilized into the SMS Annex change room and SMS Annex 2. The employer did not institute an air monitoring program to determine employee exposure to benzene.
