29 CFR 1910.95(c)(1):     29 CFR 1910.95(c)(1):  A continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (n) was not instituted when employee noise exposures equaled or exceeded an 8-hour time-weighted average (TWA) sound level of 85 dBA:    An effective hearing conservation program which included noise monitoring, audiometric testing of employees and training of employees as detailed in the standard was not instituted by Venus Processing and Storage, Inc.      a) Venus Processing and Storage Inc.  - On January 26, 2012, an employee conducting Roll forming operations was exposed to continuous noise levels at 143.1% of the allowable 8 hour time weighted average sound level (90 dBA). The equivalent dBA of 143.1% for 466 minutes is approximately 92.6 dBA. Zero exposure was assumed for the unsampled period of time of 14 minutes.     b)  Venus Processing and Storage Inc.  On January 26, 2012, an employee conducting roll forming operations was exposed to continuous noise levels at 71.6 % of the allowable 8 hour time weighted average sound level (90 dBA). The equivalent dBA of 71.6 % for 471 minutes is approximately 87.6 dBA. Zero exposure was assumed for the unsampled period of time of 9 minutes.     c) Venus Processing and Storage Inc.  On January 26, 2012, an employee conducting punch press operations was exposed to continuous noise levels at 95.6% of the allowable 8 hour time weighted average sound level (90 dBA). The equivalent dBA of 95.6% for 470 minutes is approximately 89.7 dBA. Zero exposure was assumed for the unsampled period of time of 10 minutes.      d) Venus Processing and Storage Inc.  On January 26, 2012, an employee conducting punch press operations was exposed to continuous noise levels at 87.1% of the allowable 8 hour time weighted average sound level (90 dBA). The equivalent dBA of 87.1% for 462 minutes is approximately 89.0 dBA. Zero exposure was assumed for the unsampled period of time of 18 minutes.

29 CFR 1910.213(h)(1):     The sides of the lower exposed portion of the blade of radial saw(s) were not guarded to the full diameter of the blade by a device that automatically adjusted itself to the thickness of the stock and remained in contact with the material being cut:    a) Venus Processing & Storage Inc. - The employer did not ensure the Dewalt radial arm saw, located in the back of facility by the material storage area in the northeast corner of the facility, was equipped with guards to protect employees from the lower exposed portion of the blade. Employees operated the saw to cut wooden spacers for metal products for storage and shipping.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:      a) Venus Processing and Storage Inc. - The employer did not implement at the workplace a written hazard communication program in accordance with 29 CFR 1910.1200 that describes at least the following:     1) Requirement for labeling of containers of hazardous chemicals:   2) Material safety data sheet(s) availability;   3) Training of employees;   4) A complete list of hazardous chemicals known to be in the workplace;   5) Methods to inform employees of the hazards of non-routine tasks; and,   6) Methods to inform other employer(s) of material safety data sheets availability; the labeling system and any precautionary measures to protect employees.     The employees who conduct roll forming and manufacturing operations were exposed to hazardous chemicals, including, but not limited to: Perkut 240-LC (contains Hydraulic Light Naphanic oil, flash point 225F), PerLube AW-32-5 (contains Severally Hydraulic Mineral oil, flash point 380F), PerLube EP-320 (contains Paraffinic Distillates Heavily treated, flash point 500F), PerLube EP 460 (contains Paraffinic Distillates Heavy Hydraulic Oil, flash point 550 F), PerLube EP 680 (contains Naphthenic Distillate Heavy oil, flash point 550 F), Rock Valley Pto 32 Az (contains Petroleum Distillates, Flash Point 275 F) and  Rock Valley Trojan 220 (contains Severally Hydraulic Mineral oil, flash point 490F).
