OSH ACT of 1970 Section (5)(a)(1):      Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of struck by injuries.     a) Venus Processing and Storage, Inc., at the material storage and loading areas - The employer did not conduct frequent inspections on the underhung electric hoists to ensure that damaged equipment such as hooks and pendant control directional buttons, were taken out of service until repaired.      Among other methods, one feasible and acceptable means of abatement to correct this hazard is to conform with the requirements of the American Society of Mechanical Engineers for Overhead Hoists (Underhung) - ASME B30.16-2007, Inspection, Testing, and Maintenance, chapter 16-2.1-16-2.1.3., by requiring the implementation of not only periodic inspections, but also frequent inspections which include the Pendant boxes, hooks, and chains.
