29 CFR 1910.95(d)(1):   The employer did not develop and implement a noise monitoring program when information indicated that any employee's exposure may equal or exceed an 8-hour time-weighted average of 85 decibels:    1) On January 18, 2012, and at prior times, the employer had not developed and implemented a noise monitoring program.    On January 18, 2012, an employee operating a molding machine was exposed to noise levels of approximately 86.34 dBA as an 8 hour time weighted average for the 323 minute sampling period.    Note:  Noise dosimetry for three employees in the shop indicated exposures above 85 dBA for the time sampled, which indicated potential for exposure above 85 dBA as an 8 hour time weighted average if the facility returns to an 8 hour shift operation.
