29 CFR 1910.147(c)(1):     The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:      a) At the facility, on or about 1/19/12: An energy control program was not developed to prevent the unexpected startup during servicing of equipment including a baler.       Abatement certification must be submitted for this item.

29 CFR 1910.157(g)(1):     An educational program was not provided for all employees to familiarize them with the general principles of fire extinguisher use and the hazards involved with incipient stage fire fighting:      a) At the facility, on or about 3/14/12: Where employees are expected to fight incipient stage fires, training on the principles of fire extinguisher use was not conducted at least annually.       ABATEMENT NOTE:  By this date the employer must either correct the alleged violation or implement a Fire Safety Policy; as outlined in 29 CFR 1910.38(a) and .39 which includes the evacuation requirements of 29 CFR 1910.157(b).    Abatement certification must be submitted for this item.     Ben Weitsman & Son Inc was previously cited for a violation of this occupational safety and health standard or its equivalent standard which was contained in OSHA inspection number 310755558, citation number 1, item 1, issued on 6/16/2008.
