29 CFR 1910.178(l)(4)(ii)(B):     Refresher training, including an evaluation of the effectiveness of that training, shall be conducted as required by paragraph (l)(4)(ii) to ensure that the operator has the knowledge and skills needed to operate the powered industrial truck safely.  Refresher training in relevant topics shall be provided to the operator when the operator has been observed to operate the vehicle in an unsafe manner and/or the operator has been involved in an accident or near-miss incident;      a.  At the work site, an employee struck a building support with a fork lift, bending the forks, snapping off the hydraulic fluid filter, and ejecting the driver from the lift.  The employer had no documentation that the employee had ever been given refresher training after the accident with a fork lift.

29 CFR 1910.178(q)(7):     Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected.    a.  At the work site, the employer did not provide for examination of powered industrial vehicles (PIVs) for defects prior to use.  Several fork lift trucks had defects that included, but were not limited to, a malfunctioning horn, a defective seat belt and a side shift that did not work.

You must complete an OSHA 301 Incident Report form, or an equivalent form, for each recordable injury or illness entered on the OSHA 300 Log. A company executive must certify that he or she has examined the OSHA 300 Log and that he or she reasonably believes, based on his or her knowledge of the process by which the information was recorded, that the annual summary is correct and complete.      At the work site located at 6000 Greene Pointe Drive South, Groveport, Ohio, an employee who worked as an industrial vehicle operator was injured in an accident in December 2011 and was not shown on the 2011 OSHA 300A Summary.  The employer had not checked the 2011 OSHA 30O A Summary form for accuracy and had not certified the form by signing it.
