29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:    a) Residential jobsite:  On February 1, 2012 and times prior thereto employees performing sheathing activities on an approximate eight in twelve pitched roof without a fall protection system in place.     b) Residential jobsite:  On February 1, 2012 and times prior thereto an employee performed framing activities on the exterior top plate without a fall protection system in place.     Note) Abatement certification IS required for this item.

29 CFR 1926.503(a)(2)(iii): The employer did not assure that each employee had been trained, as necessary, by a competent person in the use and operation of guardrail systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used:    a) Residential jobsite: On February 1, 2012 and times prior thereto employees and the responsible person on site did not recognize and/or acknowledge the potential fall hazards while performing framing activities, which included sheathing and working on the exterior top plate, and take actions to minimize or eliminate the hazards.      Note) Abatement certification IS required for this item.

Note) Eye and face protection required by this part shall meet requirements specified in American National Standards Institute (ANSI) Z87.1-1968, Practice for Occupational and Educational Eye and Face Protection.
