29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) Front of structure, upper and lower levels of the roof: On May 2, 2012 and at times prior thereto, employees performing sheathing activities on a 5 in 12 pitched roof were exposed to fall hazards ranging from approximately 10 to 20 feet without a fall protection system in place. b) Inside of structure: O n May 2, 2012 and at times prior thereto, employees performing framing activities on the second floor level were exposed to a 10 foot fall hazard at an open sided floor used for access to and from this level. Note 1) Abatement certification is NOT required for this item. Blake Richards dba NBS Construction was previously cited for a violation of this Occupational Safety and Health standard which was contained in OSHA inspection number 190576, citation 1, item 1a, and was affirmed as a final order on March 9, 2012, with respect to a workplace located at Lot 13, Block 12, Spur Wing, Meridian, ID.
