29 CFR 1926.453(b)(2)(v):     A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:  Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated    On or before February 2, 2012, during steel erection activities, the employer allowed an employee to operate an aerial lift and did not ensure that the employee was attached with a belt and lanyard. The employee was not wearing any restraint to protect him during the operation of the lift.

29 CFR 1926.760(a)(1):     Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems.      On or before February 2, 2021, during steel erection activities, the employer did not ensure that employees exposed to falls of approximately 22 feet were properly protected.    HERITAGE STEEL SERVICES INC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD, IDENTITY OF PREVIOUSLY CITED STANDARD  29 CFR .760 (a)(1)), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 63128, CITATION NUMBER 01, ITEM NUMBER 02, AND WAS AFFIRMED AS A FINAL ORDER ON December 13, 2011, WITH RESPECT TO A WORKPLACE LOCATED AT 21000 BROOKPARK RD., CLEVELAND, OHIO.
