29 CFR 1910.1200(e)(1): Employers did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met: On or about 02/03/12, The employer did not implement all the requirements of the company's written hazard communication program including providing training and notifying employees of the location of the MSDSs for product used at the jobsite. Rmployees ork with chemicals to include but not limited to Serpiloc clear (filled vinyl & acrylic emulsion), Bullwet (non-ionic surfactant), misty heavy duty adhesive spray and pronto low odor mastic remover. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 AS PER 29 CFR 1903.19.

29 CFR 1910.1200(h)(1): Employers did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area: On or about 02/02/12, Employees performing asbestos abatement utilize substances that include Serpiloc Clear (filled vinyl & acrylic emulsion), Bullwet (non-ionic surfactant), Misty Heavy Duty Adhesive Spray and Pronto Low Odor Mastic Remover were not provided site specific training on the hazards of the chemicals they work with. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 AS PER 29 CFR 1903.19.

29 CFR 1926.1101(f)(5)(i): The employer did not notify affected employees of the monitoring results that represent that employee's exposure as soon as possible following receipt of monitoring results: On or about 02/03/12, Asbestos handlers that were monitored inside of the containment were not provided with the result of their exposure monitoring. Workers were never informed to check for monitoring results which which were posted on a bulletin board on the floor.
