29 CFR 1910.215(b)(9): Exposure adjustment. Safety guards of the types described in Subparagraphs (3) and (4) of this paragraph, where the operator stands in front of the opening, was not constructed so that the peripheral protecting member can be adjusted to the constantly decreasing diameter of the wheel.     The maximum angular exposure above the horizontal plane of the wheel spindle as specified in paragraphs (b)(3) and (4) of this section shall never be exceeded, and the distance between the wheel periphery and the adjustable tongue or the end of the peripheral member at the top shall never exceed one-fourth inch:    (a) In the ground maintenance shop on or about February 9, 2012, and at times prior thereto, there was no tongue guards on a Central Machinery 8 inch bench grinder.  The grinder's 8.75 inch by 5/8 inch abrasive wheel was used to grind small metal parts such as equipment switch covers.

29 CFR 1910.305(g)(1)(iv)(A): Unless specifically permitted otherwise in paragraph (g)(1)(ii) of this section, flexible cords and cables may not be used as a substitute for the fixed wiring of a structure;    (a) In the ground maintenance shop on or about February 9, 2012, and at times prior thereto, permanent wiring was not used to power permanently mounted 110 VAC Dayton drill press and a Central Machinery bench grinder.  The equipment was powered through a reel up extension cord and a surge bar.

29 CFR 1910.334(a)(2)(ii):  When there was a defect or evidence of damage that might expose an employee to injury, the defective or damaged item was not removed from service, and no employee may use it until repairs and tests necessary to render the equipment safe were made.    (a) In the ground maintenance shop on or about February 9, 2012, and at times prior thereto, electrical equipment with a damaged cord was used as the outer insulation was pulled away from the plug on a surge bar, used to power 110 VAC Dayton drill press and a Central Machinery bench grinder.
