29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact: (a) On February 28, 2012, or at times prior thereto, the controlling and/or exposing employer Mega United, failed to ensure the use of seatbelts when operating a Caterpillar 420E Backhoe, License Number 1163 SEQ, on Lot Number 101-4B-10, Duendes Street, Mongmong, GU. Seat belts are a component part of an operator restraint system that is designed to reduce the incidence and severity of injuries to the operator in the event of a accident, and that the failure to wear the seat belts that are provided in the backhoe increases the risk of injury to the operator in the event of an accident.

29 CFR 1926.405(g)(2)(iv): Flexible cords were not connected to devices and fittings so that strain relief is provided to prevent pull from being directly transmitted to joints or terminal screws: (a) At the project site on or about February 28, 2012, and at times prior thereto, an energized extension cord was used to provide power to a Bosch 11236VS Hammer Drill (Serial Number unreadable). The black casing that surrounds the male plug end was pulled out, thus straining the cord and potentially causing the strands of one conductor to loosen from under terminal screws and touch another conductor.
