29 CFR 1926.21(b)(2):     The employer did not instruct each employee in the recognition and avoidance of unsafe conditions andthe regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.    On or about 02/20/12 A day laborer was not trained as to the safe operating pressure of the tires he was inflating nor was he given instructions on how to safely inflate tires.  The tires were on a TRAK INTL Model 3606 highlift used to move materials at the residential home consturction site. The employee was exposed to the hazards of being struck by tires.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps tha it is taking to ensure that workers are trained in how to safely inflate tires.

29 CFR 1926.25(a):     During the course of construction, alteration, or repairs, form and scrap lumber with protruding nails,and all other debris, was not kept cleared from work areas, passageways, and stairs, in and around buildings or other structures.    On or about 02/20/12 a scrap 2x4 piece of lumber was lying with protruding nails face up was on the ground near the entrance of the construction site.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that the scrap lumber with nails is removed from the construction site.

29 CFR 1926.602(a)(9)(i):     All bidirectional machines, such as rollers, compacters, front-end loaders, bulldozers, and similar equipment, were not equipped with a horn, distinguishable from the surrounding noise level, which shall be operated as needed when the machine is moving in either direction. The horn shall be maintained in an operative condition.    On or about 02/20/12 A TRAK INTL MODEL 3606 highlift did not have a working horn.  The highlift was used to move roofing materials at the residential home construction site.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that high lift truck has a working horn.

29 CFR 1926.602(c)(1)(vi):     Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks.     On or about 02/20/12 A laborer was not provided with a air pressure gauge and training on how to safely inflate the tires of a Sky Trak Model 3606 forklift.  This exposed him to the hazard of being struck by an exploding tire.  The forklift was located at the construction site.      Ref:  ANSI B56.1-1969, Safety Standards for Powered Industiral Trucks, page 7 MAINTENANCE PRACTICES, paragraph 702  Maintenance and inspections of all powered industrial trucks shall be performed in conformance with the manufacturers recommendations...     Ref:  Sky trak Model 3606 forklift General Maintenance manual, page 138, section 13. Wheels and Tires, A. Tire Air Pressure Check, paragraph 2. Check tire pressure using a good quality gauge.  You cannot tell if a tire is properly inflated simply by looking at it.
