OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. a) At FST Logistics, there was a below-the-hook lifting device that was used for lifing fork lift batteries that had a data plate that was illegible, thereby exposing employees to struck-by and caught-between hazards.

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees At FST Logistics, there was a Dayton one ton manual chain hoist that was used to lift fork lift batteries that weighed 2,120 lbs. The chain hoist was under capacity for the load being lifted, thereby exposing employees to struck-by and caught-between hazards.
