29 CFR 1910.23(a)(2): Every ladderway floor opening or platform shall be guarded by a standard railing with standard toeboard on all exposed sides (except at entrance to opening), with the passage through the railing either provided with a swinging gate or so offset that a person cannot walk directly into the opening: Employees performing work on the roof of the mill such as maintenance on the bucket elevator legs were exposed to fall hazards up to fifteen feet to the next lower level. The ladder openings for the following locations did not have gates or chains in the openings to prevent falls through those openings: a) Ladder from the roof of the truck dump to the pellet mill roof. b) Ladder from the roof of the feed mill to the truck dump roof c) Ladder from the truck dump roof to the distributor portion of the truck dump roof. d) Ladder opening from the motor platform to the distributor platform in the grain elevator.

29 CFR 1910.23(a)(3)(i): Hinged floor opening cover of standard strength and construction equipped with standard railingsor permanently attached thereto so as to leave only one exposed side. When the opening is not in use, the cover shall be closed or the exposed sideshall be guarded at both top and intermediate positions by removable standard railings: Employees performing housekeeping and maintenance tasks were exposed to fall hazards up to 28 feet. The floor openings for fixed industrial ladders did not have hatches for the following locations: a) Opening on the upper floor of the pellet mill, next to the cyclone dust collector to the ground floor. b) Ladder from distributor platform in the grain elevator to the bin deck.

29 CFR 1910.272(j)(1): The employer shall develop and implement a written housekeeping program that establishes the frequency and method(s) determined best to reduce accumulations of fugitive grain dust on ledges, floors, equipment, and other exposed surfaces: Employees working in and near the feed mill were exposed to fire and explosion hazards. The employer had not fully implemented a housekeeping program to address how often and the methods required to address housekeeping in the feed mill. The Bartlett Cooperative Association was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.272(j)(1) which was contained in OSHA inspection number 315085852, citation number 01, item number 001 and was affirmed as a final order on June 13, 2011, with respect to a workplace located at 401 N. Main St., Bartlett, Kansas.

29 CFR 1910.22(a)(1): The employer did not immediately remove any fugitive grain dust accumulations whenever the exceeded 1/8 inch (0.32cm) at priority housekeeping areas, pursuant to the housekeeping program for grain elevators: Employees working in and near the feed mill were exposed to fire and explosion hazards. Dust accumulations were found greater than 1/8 of an inch in the following locations: a) Upper level of feed mill by manlift. Depth measured 2 inches deep. b) Pellet mill upper level under the cyclone. Depth measured 12 inches deep. c) Boot pit of feed mill by south leg. Depth Measured 8 inches deep. d) Boot pit of feed mill by north leg. Depth measured 8 inches dep. The Bartlett Cooperative Association was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.272(j)(2)(ii)) which was contained in OSHA inspection number 315085852, citation number 01, item number 002 and was affirmed as a final order on June 13, 2011, with respect to a workplace located at 401 N. Main St., Bartlett, Kansas. 29 CFR 1903.19(d0(1) requires certification and documentation that the abatement of the above violation is complete. ABATEMENT DOCUMENTATION REQUIRED FOR THIS ITEM
