29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person:     a)  Luna Roofing, 36980 County Road 37, Eaton, CO:  The employer had not ensured a competent person conducted frequent inspections to identify and correct hazards associated with residential roofing work.  On or about March 9, 2012, employees were permitted to work on a 7/12 pitch roof without an appropriate fall protection system.  Condition exposed employees to a fall hazard of approximately 10 feet.    OSHA defines a "competent person" as someone capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.    Abatement Note:  Abatement certification is required for this item (See enclosed Abatement-Certification Letter).

On or about March 9, 2012, employees were permitted to work on a 7/12 pitch roof without appropriate fall protection.  Condition exposed employees to a fall hazard of approximately 10 feet.    Abatement Note:  When the employer demonstrates that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan meeting the requirements of paragraph (k) of 1926.502.    Abatement Note:  Abatement certification is not required for this item.    Luna Roofing was previously cited for a violation of this Occupational Safety and health standard or its equivalent standard CFR 29 CFR 1926.501(b)(13) which was contained in OSHA inspection number 313417982, citation number 1, item number 2, issued on November 9, 2009, with respect to a workplace located at 151 Muscovey Lane.
