29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c): (a) Aspen Homes of Colorado, Inc. at 3330 Hewitt St, Loveland, CO 80538: On March 13, 2012, the controlling employer did not ensure that each subcontractor employee working between the vertical side of the excavation and the concrete formwork on the west side of the basement excavation was protected from cave-in. The soil on the west side was undercut due to sloughing the previous day. The depth of the west side of the excavation was approximately 7.5 feet and the horizontal distance from the side of the excavation to the formwork was approximately 4.5 feet. This condition exposed subcontractor employees erecting concrete forms on the west side to crushing hazards by excavation wall cave-in.
