29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact. a) Hillside Builders, LLC on or about March 21, 2012, at the site address of Sub Lot 91 Westport Pl., Avon Lake, OH: The employer did not ensure employees were wearing appropriate eye protection such as, safety glasses while using a circular saw and a pneumatic nail gun during wood framing operations. The employees using these tools without eye protection were exposed to potential eye injuries from flying particles.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. a) Hillside Builders, LLC on or about March 21, 2012, at the site address of Sub Lot 91 Westport Pl., Avon Lake, OH: The employer did not ensure employees were adequately protected from falls while installing floor sheeting atop the second story of a residential structure. During this work, employees were exposed to falls of approximately 10ft to the ground below.
