29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): On or about April 3rd, 2012, employees operating and working near the Mustang, Model 634, Telehandler were exposed to struck-by hazards, in that employees who had driven the above mentioned forklift had not been trained prior to operating the powered industrial truck.

29 CFR 1926.602(c)(1)(vi): All industrial trucks in use shall meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks: On or about April 3rd, 2012, employees operating and working near the Mustang Model 634 Telehandler were exposed to struck-by hazards. The operators were not performing daily inspections to ensure all items on the forklift were working and adjusted as necessary such as but not limited to, warning devices and safety devices like mirrors, prior to operating the forklift, as described in ANSI B56.1-1969, Section 7, Paragraph I.
