OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being impaled or severely lacerated on protruding metal studs:    Main building 2nd floor NNE corner- On or about 4 April, 2012 - Employees were exposed to potential impalement or severe lacerations in that the arched track metal studs did not have covers on them or protected in such a way to prevent an impalement or severe laceration wound.

29 CFR 1926.404(f)(6): The path to ground from circuits, equipment, or enclosures was not permanent and continuous:    a) Main building 2nd floor NNE corner- On or about 4 April, 2012 - Employees used an electric power tool that was missing the ground prong on its cord that provides a permanent path to ground. Employee was using a Milwaukee Sawzall model 6536-21, serial number A66D611210013 that requires as per manufacturer a ground. Employee was exposed to an electrocution hazard.

29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person:      a) Main building 2nd floor NNE corner- On or about 4 April, 2012 - Employees used an electric power tool, Milwaukee Sawzall model 6536-21, serial number A66D611210013  that had the ground prong missing on its power supply cord. Inspection of tool prior to work was not completed by a competent person to identify the electrical cords defective plug. Tool requires grounding as per manufacturer label.  Employees were exposed to an electrocution hazard.

29 CFR 1926.405(a)(2)(ii)(E): Lamps used in temporary wiring for general illumination were not protected from accidental contact or breakage:    a)Main building 2nd floor NNE corner- On or about 4 April, 2012 - One light fixture on the string of temporary lighting was found to be unguarded. Employees are exposed to burns from contact with hot bulb and electrocution from broken fixture.
