29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact: a) D.L. Chambers Home Improvement, LLC, Findlay, Ohio: On or about April 5, 2012, at address 1623 Forest Park, Findlay, Ohio, the employer failed to ensure that each employee used appropriate eye protection while engaged in nailing activities, such as securing shingles to the structure roof with a pneumatic nailer, exposing employees to eye injuries from flying particles.

Chambers Home Improvement, LLC, Findlay, Ohio: On or about April 5, 2012, at address 1623 Forest Park, Findlay, Ohio, the employer did not ensure that employees were protected from falls while applying new roofing to a steep sloped roof on a residential type structure. Employees were exposed to a potential fall of approximately 10 feet to the ground below, which could result in permanent disability for death.
